The state appeals the trial court's denial of a motion to overturn the court's previous order, which set aside the respondent's guilty plea to second degree murder. The case was assigned to the Idaho Court of Appeals. That court affirmed the district court in an opinion issued August 3, 1982, State v. Goodrich, 103 Idaho 430, 649 P.2d 389 (Ct.App.1982). This Court granted a petition to review the Court of Appeals decision. We reverse. On October 17, 1973, respondent shot and killed her ex-husband, Brent Goodrich, who was staying at her house at the time. On January 23, 1974, she was charged with second degree murder. She was tried before a jury and convicted on May 25, 1974, and sentenced to life in prison.
